Terms of use

§ 1 Scope and provider

These terms apply to the use of the game ZORALEN in the browser, the ZORALEN game account and the ZORALEN website. The provider is OSSAI UG (haftungsbeschränkt), Ibacher Mühle 4, 42855 Remscheid, Germany (see legal notice), hereinafter "we".

If you buy ZORALEN on Steam, the purchase contract is concluded with Valve Corporation; the Steam Subscriber Agreement and Steam's refund rules apply in addition. These terms also apply to playing the game there.

Deviating terms of users do not apply.

Purchase of the web version and refunds

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all orders of the web version: the purchase contract is concluded with Paddle, and Paddle handles payment, invoicing, sales tax/VAT, refunds and order enquiries. Paddle's buyer terms apply in addition. The licence is credited to the ZORALEN account from which you started the purchase in the game.

Refunds: Within 14 days of purchase we refund the full price, no questions asked. Contact Paddle via the link in your order confirmation or at paddle.net, or write to info@ossai.de. A refund removes the web version from your account; your progress is kept. Statutory rights, in particular any right of withdrawal under Paddle's buyer terms, remain unaffected.

§ 2 Service

Until launch, the browser version of ZORALEN is free of charge. After that, playing requires a licence: the web version (see Purchase) or the Steam version with a linked account. We strive for uninterrupted operation but do not guarantee any particular availability; maintenance, technical faults or events beyond our control may cause interruptions.

ZORALEN is continuously developed. We may change content, game mechanics, balancing, OsCoin prices and rewards where this is reasonable for you – for example to keep the game fair, fix bugs or add new content.

§ 3 Game account

1. You can play without an account. An account requires a valid email address and a minimum age of 16. If you are younger, you may only create an account with your parent's or guardian's consent.
2. Keep your password secret. You are responsible for activity under your account to the extent you are at fault. If you notice misuse, please tell us immediately.
3. Your pilot name must not infringe third-party rights and must not be insulting, discriminatory, extremist or sexually offensive. We may change such names.
4. The account is personal and not transferable.

§ 4 OsCoins, shards and other virtual items

1. OsCoins, prism shards, upgrades, paint jobs, artefacts and other game content can only be earned by playing. They cannot be bought for real money.
2. Virtual items have no monetary value. They cannot be paid out, exchanged, sold or transferred to other accounts. You acquire a simple, non-transferable right to use them in the game.
3. We may adjust the values and properties of virtual items within the scope of § 2. We may remove items obtained through errors (e.g. a bug or manipulation).

§ 5 Fair play

In particular, the following is not allowed:

• cheats, bots, macros or other programs that give you an unfair advantage;
• exploiting bugs instead of reporting them, and manipulating save games or data sent to our servers;
• attacks on our servers or overloading the services;
• harassing, insulting or threatening other players, including through names or markers in multiplayer.

§ 6 Videos, streams and screenshots

You may create and publish videos, streams and screenshots of ZORALEN, including on platforms with advertising revenue (e.g. YouTube, Twitch). Please do not give the impression that it is official content from us. Beyond that, you may not copy or distribute the game content itself (graphics, music, code).

§ 7 Term, deletion and suspension

1. You can delete your account in the game at any time. Progress and virtual items are then irrevocably lost.
2. For violations of these terms we may, depending on severity, issue a warning, remove results from leaderboards, temporarily suspend the account or terminate it. We take your legitimate interests into account; a permanent ban generally requires a prior warning, except for serious violations.
3. We may discontinue free game operation with three months' notice. We will inform account holders by email beforehand.

§ 8 Liability

1. We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the German Product Liability Act.
2. For slight negligence we are only liable for breach of an essential obligation whose fulfilment makes proper performance of the contract possible in the first place and on whose compliance you may regularly rely – and then limited to the foreseeable, typical damage.
3. Where we provide the game free of charge (in particular until launch), we are otherwise only liable for it for intent and gross negligence (by analogy with § 521 German Civil Code).
4. These limitations also apply to our employees and agents.

§ 9 Privacy

How we handle your data is described in the privacy policy.

§ 10 Changes to these terms

We may change these terms with effect for the future if there is an objective reason (e.g. new features or changes in the law). We will inform account holders by email at least six weeks in advance. If you do not object within this period, the changes are deemed accepted; we will point this out separately in the notice. If you object, either party may terminate the account.

§ 11 Final provisions

1. The German version of these terms is binding; the English version is for information.
2. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident in another country, the mandatory consumer protection provisions of that country remain unaffected.
3. If parts of these terms are invalid, the rest remains valid.
4. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
